1. Introduction
Welcome to Kiosk Caricature Crafter. These General Terms and Conditions (GTC) govern your use of our services and the purchase of products from our kiosks. By making a purchase, you agree to be bound by these terms.
2. Service Provider
The service is provided by Perimedeus Kft. (tax number: 23381438-2-19), contactable at daniel@pathcraftvr.com.
3. Service Description
The Kiosk Caricature Crafter provides an automated service that generates and prints a caricature. The service is initiated upon successful payment.
4. The Contract
A binding contract for the purchase of a print is formed when you complete the payment process successfully. By clicking the "Pay & Print" button, you are making an offer to purchase the service, which is accepted upon our payment provider's confirmation of the transaction.
5. Payment
All payments are processed through our third-party payment provider, Barion. By initiating a payment, you agree to Barion's terms of service. The price for the service is displayed on the kiosk interface and is inclusive of all applicable taxes.
6. Fulfillment and Delivery
Upon successful payment, your print request will be added to the kiosk's queue. The kiosk will print your caricature as soon as it is ready. We are not responsible for delays caused by technical issues, but we will make every effort to ensure the service is operational. No refunds will be provided for completed prints.
7. Right of Withdrawal (Consumers)
The caricature is a personalised product created to your specifications and the service is performed immediately at your request. Under Government Decree 45/2014 (II. 26.) on distance contracts, the 14-day right of withdrawal does not apply once the service has been fully performed. By starting the capture, you expressly request immediate performance and acknowledge that you lose the right of withdrawal upon completion. This does not affect your statutory rights in the event of a faulty product or service.
8. Limitation of Liability
Our liability is limited to the purchase price of the service. We are not liable for any indirect or consequential damages.
9. Data Protection
We process personal data (including the photograph used to generate your caricature) in accordance with our Privacy Policy and Cookie Policy. Please review them before using the service.
10. Governing Law and Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of Hungary. As a consumer, you may also use the EU Online Dispute Resolution platform.
